What is a recourse sanction?

The moment you terminate the employment contract with the sick employee during the first two years of his or her illness, the former employee may be eligible for a Sickness Benefits Act benefit. The UWV will then assess whether the employer and the employee have done enough within the framework of reintegration during the employment. The reintegration report will be assessed by the UWV.

Has the employer not done enough? Then UWV may impose a recovery sanction and the sick pay is recovered (partially) from the employer. The period over which the benefit is recovered is based on the time that the reintegration obligation was not met. This is a maximum of 52 weeks.
