Once you have been sick for 104 weeks, sickness benefits from Resolu (on behalf of your former employer) will end. A WIA benefit is the successor benefit to your sickness benefit. Between week 88 and week 93 of sick leave, you can apply for WIA online for this purpose.

WIA application

Your case manager will make arrangements with you about making the application. It is important to know that you are responsible for a timely WIA application. In case of a late application, you are responsible for the financial bridging until the UWV will pay your WIA benefit.

  • You will receive a letter from the UWV in week 88, which will tell you the deadline when you can submit your WIA application. Agree with your case manager when you want to submit the application.
  • You can apply through the UWV.
  • You will need a laptop/computer and a working DigiD.
    If you do not have DigiD or are not computer literate, we would like to request that you notify your case manager as soon as possible. The case manager cannot do the application for you, but can think along with you.
  • Resolu sends the non-medical and medical documents. You can view the non-medical documents, also known as your reintegration report, yourself online via your "employee file." The medical documentation, also known as the medical information, is bundled and sent by the company doctor. It is important that we send your documentation around the same day as you file. Your case manager will coordinate this with you.
  • If necessary, the UWV may request further documentation.
  • Finally, you will receive an acknowledgement of receipt from the UWV.

WIA assessment

As soon as the WIA application and accompanying documentation have been received in good order, the WIA assessment is started by the UWV. It is assessed whether you are entitled to WIA benefits; this assessment is similar to the (first-year) sickness benefit assessment.

  • The reintegration (agreements) and your sickness benefit continue until 104 weeks of absence, also called "end of waiting period."
  • First, the UWV assesses through the RIV test whether during the absence sufficient reintegration has been done. If it appears that insufficient reintegration effort has been made, the UWV may decide to impose a wage penalty. This means that your ex-employer and you will have to continue the reintegration process and that your ex-employer has an obligation to continue to pay wages for up to one year. You will not yet receive a WIA decision from the UWV.
  • After the RIV test, you will be invited to see an insurance physician at the UWV. The insurance physician will prepare an FML (Functional Ability List) and a medical report.
  • If the insurance physician is of the opinion that you can still work (partially), you will meet with an employment expert from the UWV. Using your FML and the CBBS (Claim Assessment and Assurance System), the labor expert examines what kind of work you can do and how much you can earn. This ultimately results in a disability percentage.
  • You will receive by mail the decision with more information about your WIA benefit.

WIA decision

Different decisions can come out of the WIA assessment, depending on your disability percentage. Your disability percentage is calculated based on your theoretical earning capacity relative to your old wage. So it looks at what you could earn with your limitations and how this relates to your old wage.

Disability rate Impact of decision
0-35% You will not receive WIA benefits. You can apply for unemployment benefits.
35-80% You are entitled to WIA benefits(WGA).
80-100% not permanently disabled You are completely, but not permanently, disqualified. You receive a WIA benefit (WGA).
80-100% permanently disabled You have a full permanent disability. You receive an IVA benefit.

Consequences of your WIA decision

Each decision will have different consequences for you, both financially and in terms of your reintegration obligations. Your case manager will inform you at a later time and may already give you an expectation. However, it remains difficult to inform you as fully as possible as long as no WIA decision has been made by the UWV.

You will also be counseled after the decision and during WIA benefits. This may be by the UWV or another party, depending on the choice of your former employer.

Late decision

Due in part to the shortage of insurance doctors, the UWV's decision period has been delayed. Deadlines vary by UWV office. The UWV cannot issue an expectation. It may be that your sickness law is terminated at 104 weeks and there is still no decision on the WIA application. In that case you can request a monthly advance from the UWV, this can be done 2 weeks before the end of the waiting period/ 104 weeks of absence.

After the expiration of the 104 weeks of absence, you can request the UWV to still make a decision within 2 weeks. You can do so by filing a "notification of late decision" with the UWV. You may also be eligible for compensation.
